Welcome to BeatFrame! These Terms of Service ("Terms") govern your use of the BeatFrame device and associated services ("Service"). By using our Service, you agree to be bound by these Terms.
IMPORTANT: By using, pairing, or operating your BeatFrame device, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By purchasing, registering, or using a BeatFrame device, you agree to:
- These Terms of Service
- Our Privacy Policy
- Spotify's Terms of Service (when connecting your Spotify account)
- Any additional terms presented during device setup or feature activation
2. Service Description
BeatFrame provides:
- A hardware device that displays album artwork and visual effects
- Integration with Spotify to show currently playing tracks
- Weather information display (optional)
- Various display modes and customization options
- Web-based configuration interfaces (beatframe.io and beatframe.local)
Third-Party Services: BeatFrame relies on third-party services including Spotify and OpenWeatherMap. Service availability may be affected by these providers.
3. User Requirements
3.1 Account Requirements
- You must have an active Spotify account (Free or Premium) to use music display features
- You must be at least 13 years old to use the Service
- You must provide accurate information during device registration
3.2 Technical Requirements
- A stable 2.4GHz WiFi network with internet access
- Compatible device for initial setup (iPhone recommended)
- Continuous power supply to the BeatFrame device
4. Acceptable Use
4.1 You Agree To:
- Use the Service only for lawful purposes
- Maintain the security of your device and account credentials
- Comply with all applicable laws and regulations
- Respect intellectual property rights of displayed content
4.2 You Agree NOT To:
- Attempt to reverse engineer, decompile, or disassemble the device or software
- Modify, tamper with, or hack the device hardware or firmware
- Use the Service to violate any third-party rights
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to other users' devices or data
- Use the Service for any commercial purpose without authorization
- Remove, obscure, or alter any copyright, trademark, or proprietary notices
5. Spotify Integration
BeatFrame's integration with Spotify is subject to:
- Authorization: You must grant BeatFrame permission to access your Spotify account
- Limited Access: We only access currently playing track information
- Spotify Terms: Your use of Spotify through BeatFrame is subject to Spotify's Terms of Service
- Revocation: You may revoke access at any time through Spotify's settings or device settings
Not Affiliated: BeatFrame is not affiliated with, endorsed by, or sponsored by Spotify AB. Spotify is a trademark of Spotify AB.
6. Intellectual Property
6.1 BeatFrame Ownership
BeatFrame and its licensors own all rights, title, and interest in:
- The BeatFrame device hardware design
- Firmware, software, and code
- BeatFrame branding, logos, and trademarks
- Website content and design
- Documentation and user guides
6.2 User Content
Album artwork and music metadata displayed on your BeatFrame are owned by their respective copyright holders. BeatFrame merely displays content you have access to through Spotify.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:
- Warranties of merchantability and fitness for a particular purpose
- Warranties of non-infringement
- Warranties regarding accuracy, reliability, or availability of the Service
- Warranties that the Service will be uninterrupted or error-free
No Guarantee: We do not guarantee that:
- The Service will meet your specific requirements
- Album artwork will always be available or display correctly
- Weather information will be accurate or up-to-date
- The device will be compatible with all WiFi networks
- Software updates will not introduce bugs or issues
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEATFRAME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
We are not liable for:
- Data loss or corruption
- Device malfunction or failure
- Service interruptions or unavailability
- Third-party service failures (Spotify, OpenWeatherMap, etc.)
- WiFi network issues or connectivity problems
- Electrical damage (use appropriate power sources)
- Loss of content or settings due to device reset or failure
Maximum Liability: Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid for your BeatFrame device.
9. Hardware Warranty
9.1 Limited Warranty
BeatFrame devices come with a limited hardware warranty covering manufacturing defects:
- Duration: 1 year from date of purchase
- Coverage: Manufacturing defects in materials and workmanship
- Exclusions: Damage from misuse, accidents, modifications, or normal wear and tear
9.2 Warranty Claims
To make a warranty claim, contact us at hi@beatframe.io with:
- Proof of purchase
- Device ID
- Description of the defect
10. Software Updates
We may provide firmware and software updates:
- Automatic Updates: Your device may automatically download and install updates
- Beta Features: Some updates may include experimental features
- No Obligation: We are not obligated to provide updates or maintain compatibility
- Changes: Updates may modify, add, or remove features
Your Responsibility: Keep your device powered and connected to WiFi to receive updates. Interrupting updates may cause device malfunction.
11. Service Availability
We strive to maintain Service availability but do not guarantee uninterrupted access. We reserve the right to:
- Perform scheduled or emergency maintenance
- Temporarily suspend the Service for updates or repairs
- Modify or discontinue features with reasonable notice
- Limit access to manage server capacity
12. User Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to:
- Collection and processing of data as described in the Privacy Policy
- International data transfers
- Use of cookies and similar technologies
13. Termination
13.1 By You
You may stop using the Service at any time by:
- Unpairing your device from your Spotify account
- Disconnecting the device from power
- Requesting account deletion at hi@beatframe.io
13.2 By Us
We may suspend or terminate your access if:
- You violate these Terms
- We detect suspicious or fraudulent activity
- Required by law or legal process
- We discontinue the Service
13.3 Effect of Termination
Upon termination:
- Your right to use the Service immediately ceases
- Your device may lose functionality requiring server connection
- We may delete your data in accordance with our Privacy Policy
- Provisions regarding disclaimers, limitations of liability, and dispute resolution survive termination
14. Changes to Terms
We may modify these Terms at any time. When we make material changes:
- We will update the "Effective Date" at the top
- We will provide notice on our website
- For significant changes, we may send a notification to your device
Your Continued Use: Continuing to use the Service after changes constitutes acceptance of the updated Terms. If you do not agree to changes, you must stop using the Service.
15. Governing Law and Disputes
15.1 Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
15.2 Dispute Resolution
Before filing any legal action, you agree to contact us to attempt informal resolution:

- Allow 30 days for resolution attempts
16. Indemnification
You agree to indemnify and hold harmless BeatFrame, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of applicable laws or regulations
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeatFrame regarding the Service and supersede all prior agreements and understandings.
19. No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
